Fees: The Purchaser agrees to pay all collection, shipping and packaging fees as stipulated within the Fresh Semen Contract. If in the process of transferring any embryo(s) from the donor mare and the subsequent examinations of the recipient mare(s) no embryo(s) have survived a right of return will exist for the following breeding season (2007) for the Purchaser.

 

In addition to those fees the following will apply if more than a single embryo is flushed from the donor mare. For each additional embryo that survives 30 days within a recipient mare, the Purchaser agrees to pay the Breeding Fee of $1300.00 for Waldaire, or $800.00 for Avebury WF. (please circle the sire)

A Live Foal Guarantee will apply for all successfully implanted embryo(s) that are viewed by the veterinarian at 30 days post breeding. Each resulting embryo is considered a separate entity and all registration and recording material will be handled as such by the Stallion Owner.

 

If any resulting embryos are cryogenically stored the Purchaser agrees to pay the Breeding Fee when the embryo is successfully implanted within the Recipient Mare during the subsequent 30-day examination.

Conditions: The Purchaser agrees to submit a signed statement from the treating Veterinarian that states the results from any and all examinations and/or ultra-sound scans. The Purchasers also agrees to follow the guidelines stated within the Fresh Cooled Contract in regards to vaccination, de-worming and routine veterinary examinations for the recipient mare(s). Each recipient mare must be recorded with the Stallion Owner and photographic images, descriptions and any registration affiliation will go into the Stallion Owner’s recording file. If any DNA exists for the Recipient Mare(s), this information shall be given to the Stallion Owner prior to Embryo Transfer.

 Return of service: Purchaser shall not be entitled to a refund of fees paid hereunder except as set forth below. However, the Donor Mare shall have the right of return to the Stallion’s service in the following breeding season and in the third following season only in the following circumstances:

If the Donor Mare’s Transferred Embryo does not settle during the Present Breeding Season, she is eligible for return of service to the Stallion if the Purchaser’s veterinarian submits a certificate to that effect. The Purchaser recognizes Watermark Farm’s right to require a negative intrauterine culture certificate prior to the Donor Mare’s return to service.

If the Recipient Mare is examined in foal at 30 days but becomes barren during gestation after the 50 to 60 day examination, she is eligible for return if Watermark Farm receives a certificate within five (5) days of the examination.

If the Recipient Mare subsequently produces a live foal that is unable to stand alone and nurse, and subsequently dies, a veterinary certificate must be provided within five (5) days of death.

The Donor Mare Owner agrees that if this breeding contract is not used within the next two subsequent breeding years, this contract will be terminated and all fees will be forfeited.

In all cases, the required veterinary certificate shall affirm that the Recipient Mare(s) had been immunized for equine rhinopneumonitis (equine herpes type 1) during pregnancy and the dates of such vaccination. Where appropriate, the certificate shall also confirm that the Recipient Mare(s) was/were properly cared for during gestation and foaling was attended. Watermark Farm’s timely receipt of the required veterinary certificates is a condition precedent to any right of return.

If the Purchaser’s Donor Mare becomes unfit for breeding or otherwise unbreedable, another mare may be substituted with Watermark Farm’s consent. Purchaser must make this request in writing.

 

Refund of Fees: This contract shall be null and void and the Purchaser shall be entitled to a refund of any amount paid hereunder if the Stallion should die or become unfit for service prior to serving the Donor Mare in the Present Breeding Season. The Purchaser shall not be entitled to any refund if the Stallion should die, or become unfit for service after semen has shipped or in any subsequent breeding season. No refund is available if Stallion is sold; but Purchaser may breed to another Watermark Farm Stallion of equal or lesser Stallion Service Fee.

 

Non-assignment: This contract cannot be assigned or transferred by the Purchaser. There shall be no right of return to the Stallion if the Donor Mare is sold or otherwise changes ownership after having been served by the Stallion.

 

Warranty: Watermark Farm is not responsible for lost, delayed, or damaged semen and makes no representations or warranties of any kind with respect to any semen furnished hereunder except that it is the Stallion’s. ALL WARRANTIES OR MERCHANTABILITY AND FITNESS FOR PURPOSE ARE HEREBY EXCLUDED.

Governing Law: This contract shall be governed by the laws of the Commonwealth of Pennsylvania and shall be binding upon the parties hereto and their personal representatives.
